Terms of Service for Baby Color Tap

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and Epic Technology Limited (“Company”, “we”, “us”, or “our”) concerning your access to and use of the Baby Color Tap mobile application (“the App”).

By downloading, installing, or accessing the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the App and must discontinue use immediately.

The App is intended for use by infants and toddlers under the supervision of a parent or legal guardian. As the App cannot be used to form a binding contract by a minor, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and you agree to these Terms on behalf of yourself and any minor child you authorize to use the App. You remain solely responsible for the supervision of the minor’s use of the device and the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the App on a mobile device owned or controlled by you, strictly for personal, non-commercial purposes.

3. Prohibited Conduct

You agree not to, and will not permit others to:

License, sell, rent, lease, assign, distribute, host, or otherwise commercially exploit the App.
Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.
Remove, alter, or obscure any proprietary notice (including copyright or trademark notices) of the Company.

4. Fees and Service Availability

The App is currently provided at no cost to the User. Access to the App’s current features does not require a subscription, one-time payment, or the consumption of advertisements. However, the Company reserves the right to:

Modify, suspend, or discontinue the App, or any service or feature provided therein, at its sole discretion and without notice.
Implement fees for the App or specific premium features in the future, subject to updated Terms and appropriate notice.

5. Intellectual Property Rights

The App, including its source code, design, graphics, and “look and feel,” is the intellectual property of Epic Technology Limited and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

6. Limitation of Liability and Device Safety

The App includes features such as “Screen Pinning” intended to assist in child safety; however, these are provided as-is. To the maximum extent permitted by applicable law, Epic Technology Limited shall not be liable for:

Any damage to your mobile device, including but not limited to physical damage resulting from handling by a minor.
Any loss of data or unauthorized access to other device functions.
Indirect, incidental, or consequential damages arising out of the use or inability to use the App.

7. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties of any kind, whether express or implied, including without limitation the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or that access will be continuous or uninterrupted.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (“Hong Kong”), without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

9. Termination

These Terms are effective until terminated by you or us. You may terminate these Terms at any time by deleting the App and all copies of it from your device. We may terminate these Terms at any time without notice if you fail to comply with any of the provisions herein. Upon termination, the license granted to you in Section 2 shall immediately cease, and you must discontinue all use of the App.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the “Effective Date” at the top of this document. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
